Terms of Service for FLYRTI – the iPhone app and the website flyrti.com.
This English translation is provided for convenience. The German version is legally binding.
1.Scope
These Terms apply to the use of FLYRTI in the iPhone app and in the browser at flyrti.com, as well as to all free and paid services offered through them.
FLYRTI is operated by:
Schindler & Bachmann UG (haftungsbeschränkt)
Erlanger Strasse 17
91083 Baiersdorf
Germany
Email: info@schindler-bachmann.com
Website: flyrti.com
By registering or using FLYRTI, the user agrees to these Terms and the Community Guidelines.
2.Subject of the service
FLYRTI is a dating app for adults. Users can create a profile with photos and information about themselves, see profiles of other users nearby, like or skip them and chat with each other after a mutual like (match).
The range of features may be developed further, changed or extended. There is no entitlement to the permanent provision of a particular feature unless expressly agreed otherwise.
FLYRTI merely provides the opportunity to get in touch. There is no entitlement to matches, messages or meetings.
3.Registration and user account
Use requires a user account. The user undertakes to
- provide truthful information during registration and in their profile,
- use only photos of themselves,
- keep their login credentials secret,
- not pass their account on to other people, and
- not use FLYRTI for unlawful or commercial purposes.
Each person may only have one user account. The user is responsible for all activities carried out via their account to the extent they are accountable for them.
4.Age restriction
FLYRTI is intended exclusively for people aged 18 or over. Use by minors is prohibited.
During registration, the user enters their date of birth and thereby confirms that they are of legal age. This does not constitute a guarantee of technical age verification, for example by ID document or video identification.
5.User content
Users can upload photos, profile texts and messages. The user retains the rights to their content.
The user grants the operator the right to store, technically process and display this content within FLYRTI to the extent necessary. These rights serve solely to operate the service. The content will not be used for advertising purposes without the user's consent.
Profile photos are reviewed before publication. The operator may reject photos that violate these Terms or the Community Guidelines.
The user warrants that they hold the necessary rights to their content and do not infringe the rights of third parties.
6.Prohibited content and conduct
In particular, the following are prohibited on FLYRTI:
- content that violates applicable law;
- sexual content involving or concerning minors;
- pornographic or sexually explicit content;
- intimate images shared without consent;
- publishing personal data of third parties without authorisation;
- harassment, insults, threats, blackmail or stalking;
- content inciting hatred, racist or discriminatory content;
- fake profiles, fraud, romance scams or identity misuse;
- using other people's photos or texts;
- spam, advertising, prostitution or other commercial offers;
- circumventing technical safeguards or an account ban;
- actions that impair the security or operation of FLYRTI.
7.Reports and moderation
Users can report profiles that violate these Terms or the Community Guidelines directly in the app. The operator reviews reports and, depending on the severity, may in particular take the following measures:
- removal of individual content or photos,
- a warning,
- restriction of individual features,
- temporary suspension,
- permanent suspension of the user account.
In the case of serious or repeated violations, the account may be suspended immediately. In matters relevant under criminal law, the operator may, where legally permitted or required, secure information and pass it on to the competent authorities.
8.Free and paid use
Registration and the basic features of FLYRTI are free of charge. Paid subscriptions are offered for additional features:
- Premium: 9,99 € per month
- Premium+: 19,99 € per month
In addition, one-time packs of Super Likes and Boosts can be bought in the browser. The price shown at the time of purchase applies. All prices include statutory VAT.
9.Purchase and payment
Subscriptions can be purchased in the iPhone app via the Apple App Store or in the browser. For App Store purchases, payment is made via the user's Apple account; Apple's terms for App Store purchases apply in addition.
For purchases in the browser, payment is processed by the payment provider Stripe. Subscriptions are charged monthly in advance to the chosen payment method, packs once at purchase. Super Likes and Boosts from packs do not expire and are used after the daily allowance.
Before purchase, the price, billing period and essential terms are displayed. The subscription is concluded when the purchase is confirmed.
A purchased subscription applies to the respective FLYRTI account and is also available when using the browser.
10.Term, renewal and cancellation
Subscriptions run for one month each and automatically renew for another month unless cancelled at least 24 hours before the end of the current period.
App Store subscriptions can be cancelled at any time in the subscription settings of the Apple account (Settings → Apple ID → Subscriptions). Subscriptions purchased in the browser can be cancelled at any time in the settings under “Cancel contracts here”, under “Manage payment & subscription” or in text form to the operator. Cancellation takes effect at the end of the period already paid for; until then, the premium features remain available.
11.Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in the information on the right of withdrawal. Refunds for App Store purchases are handled by Apple, refunds for browser purchases via Stripe to the original payment method.
12.Deleting the user account
The user can delete their account at any time in the settings of the app or in the browser. Profile, photos, matches and messages are deleted unless statutory retention obligations prevent this.
A subscription purchased in the browser ends immediately when the account is deleted; no further charges are made. Deleting the account does not automatically end an active App Store subscription, however. To avoid further charges, it must be cancelled beforehand in the Apple subscription settings.
13.Availability
The operator endeavours to ensure operation that is as free of disruptions as possible. Availability at all times cannot be guaranteed, in particular during maintenance work, technical faults or events beyond the operator's control.
14.Meeting other users
Users are themselves responsible for their communication and meetings with other users. The operator does not verify the identity or the information of users and accepts no responsibility for the conduct of other users – online or offline.
15.Liability
The operator is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health.
For damage caused by slight negligence, the operator is only liable in the event of a breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Liability under mandatory statutory provisions remains unaffected.
The operator accepts no responsibility for content of other users and does not adopt it as its own.
16.Indemnification
The user indemnifies the operator against justified claims by third parties asserted on account of an unlawful use of FLYRTI for which the user is responsible or on account of unlawful content of the user.
17.Changes to these Terms
The operator may change these Terms if there is an objective reason for doing so and the change is reasonable for the user. Changes to existing contracts are governed by the statutory provisions.
18.Applicable law and dispute resolution
The law of the Federal Republic of Germany applies. With respect to consumers, this choice of law only applies insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
The operator is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
19.Final provisions
Should individual provisions of these Terms be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory provisions.
